Republican Rep. Josh Schriver Introducing Resolution Asking Supreme Court to Overturn Same-Sex Marriage

Lansing, MI – “Come and get it.”
That’s the response of Michigan Attorney General Dana Nessel following the announcement that Republican State Representative Josh Schriver of Oxford would be introducing a resolution that would ask the US Supreme Court to overturn the ruling in Obergfell v. Hodges which legalized same-sex marriage.
Nessel shared a picture of a wedding band along with her social media response. She and her wife are among those who wed following the Court’s decision in the summer of 2015, and one of the attorneys who fought to make same sex marriage legal in Michigan.
Schriver sent a press release on Monday stating that he and a dozen co-sponsors will introduce the resolution. “The new resolution urges the preservation of the sanctity of marriage and constitutional protections that ensure freedom of conscience for all Michigan residents,” the release stated. Schriver also sites two instances in his press release, one where a Grand Rapids wedding venue faced a civil infraction for denying a gay couple service, and the State’s announcement in 2019 that adoption agencies who discriminated against same sex couples would not receive funding, which was ultimately ruled unenforceable.
Similar resolutions have been introduced in Idaho, Iowa, Montana, North Dakota and South Dakota.
If the Supreme Court were to overturn the decision, the right for same sex couples to marry would be left to each state. Thirty five states, including Michigan, have same sex marriage bans that would become active. In 2022 the Court struck down the Roe v. Wade decision that protected abortion rights, potentially opening the door for other decisions to be reversed.The Movement Advancement Project has details of which states would be impacted.
Schriver and other Republicans will be hosting a press conference Tuesday, And Democrats are planning one as well.
Currently Republicans have the majority in the House, while Democrats have it in the Senate. Schriver represents District 66 which includes Bruce and Washington townships in Macomb County and Addison, Brandon, Oakland, and Oxford townships in Oakland County.
