Deputy Charged with Assault after Slapping Cuffed Suspect

Rochester Hills, MI -Today, the Oakland County Prosecutor’s Office authorized charges against Deputy Kevin McNally, a 27-year veteran of the Sheriff’s Office, related to an incident which occurred on November 24, 2020.
McNally responded to a 9-1-1 call related to a carjacking incident. Deputies were dispatched to WoodSpring Suites in Rochester Hills on a report of a stolen vehicle.
The caller said she had been seated in her vehicle and was attacked by the responsible. The responsible managed to get into the driver’s seat and take off with the vehicle where they proceeded to do ‘burn-outs’ in the parking lot of a nearby Meijer store.
Deputies ultimately located the stolen vehicle at the Wal-Mart which is adjacent to Meijer. McNally was the first Deputy on scene where the stolen vehicle was located. The responsible was incoherent and appeared to be under the influence of drugs and/or alcohol and McNally attempted to interview her.
After being placed in handcuffs, the responsible kicked McNally in the groin where, in turn, he slapped her across the face and became increasingly aggressive with the subject.
After the incident occurred, our routine internal systems reviewed the incident and an investigation was triggered the next morning where it was immediately investigated by the Sheriff’s Office Special Investigations Unit.
Both an internal and a criminal investigation were conducted. McNally was suspended the same day pending the results of the investigation.
The investigation findings were sent to the Prosecutor’s Office which reviewed the case and issued two charges today connected to this incident.
McNally has been charged with Misconduct in Office and Assault and Battery. He was arraigned in 52-3 District Court in Rochester Hills, and a $5,000 personal bond was set. Termination proceedings have been initiated.
The responsible, a 35-year-old female resident of Shelby Township, was previously arraigned and charged with Unlawful Driving Away Automobile (UDAA), Reckless Driving, Assault and Battery (on victim of the UDAA), and Resisting and Obstructing Arrest.
Further charges are pending the results of a blood search warrant. The responsible is currently out on bond for the above charges.
“There is absolutely nothing acceptable about these actions by the soon to be former Deputy” said Sheriff Michael J. Bouchard. “The behavior by this Deputy was wrong and will never be tolerated. The public expects more from law enforcement and the actions did not live up to our expectations or standards.”
