Hazel Park Same Sex Marriage Case Scheduled for Aug. 6 Appeal Date

The case of the Hazel Park couple who sued for equal access to marriage and second parent adoption by same sex couples has been scheduled to be heard by the 6th Circuit Court of Appeals in Cincinnati on August 6th.
The three-person panel has scheduled 30 minutes for each side to give their argument. April DeBoer and Jayne Rowse sued to have the right to marriage and adoption. The couple is raising three children and currently each child has only one legal parent, though both women are raising them. On March 21 U.S. District Court Judge Bernard Friedman sided with the women, ruling that a ban on gay marriage was Unconstitutional. The State appealed the decision. In a window period of about a day, over 300 same sex couples obtained licenses and took vows. Attorney General Bill Schuette appealed and asked for a stay, meaning that no more licenses could be issued. The State also determined that the marriages would not be recognized by the state.
DeBoer v. Snyder has an hour total, as does a pair of cases from Ohio Henry v. Himes and Obergefell v. Himes.
Bourke v. Beshear, a case from Kentucky, will be 30 minutes total, as will the case of Tanco v. Haslam out of Tennessee.
Attorney Dana Nessel, who is representing the couple, said she believes that the State is going to continue to appeal. There is a good chance her clients’ case will be chosen by the US Supreme Court. Their case is unique because it involved such a thorough roster of experts giving testimony on both sides.
